When does an ACT builder need a licence?

By Leadhand · Sources checked

Builders, including owner-builders, need an ACT licence to provide a construction service in the ACT. Choose Class A, B, C or D according to the building and the work, and add an endorsement for demolition or swimming pool installation. A corporation or partnership needs its own licence with a licensed nominee.[1]

Pick the class by the work and the building

The ACT page lists four builder classes, each with a different scope, and says you need to know your class before applying. Carpenters and bricklayers do not currently need a licence in the ACT, but builders do.

Pick the class by the work and the building
ClassScope in short
A (unlimited)Building work of unlimited height on any BCA class, other than specialist building work, plus basic building work
B (medium rise)Buildings of 3 storeys or lower on any BCA class, other than specialist building work, plus basic building work
C (low rise residential)Building work other than specialist building work on class 1, 2 or 10a buildings of 2 storeys or lower; also defined ancillary class 10b structures, excluding swimming pools and pool fences; plus basic building work
DNon-structural basic building work, other than specialist building work

Specialist work needs an endorsement

Demolition of a building and installing a swimming pool are specialist building work. They must be added to your licence as an endorsement, either in your first application or later. Check the exact licence and endorsement scope for the proposed work.

Evidence for an endorsement can include a resume of your demolition or pool experience, references from supervising builders and relevant qualifications.

What the application involves

Gather evidence of your qualification, your building work experience (applicant and verification statements) and a criminal history check no more than 6 months old. If you are applying for Class A, B or C for the first time, or your licence has been expired for more than 12 months, you must pass the ACT regulatory assessment before you submit.

Access Canberra then assesses fit and proper person, qualification and experience requirements. You may be offered a licence with conditions that restrict the scope of work.

Company or partnership

A corporation or partnership that provides or advertises building services needs its own licence. It must have at least one nominee who holds the equivalent individual ACT licence, so licence the individuals first.

First-time Class A, B or C applicants must pass the ACT regulatory assessment before applying.[1]
How can I check a builder's licence in Canberra?
Access Canberra publishes a register of licensed construction practitioners. Search it for the builder's name or company, then confirm the class and any conditions cover the work you are asking for.[1]
